[Agra] Case against CA for facilitating Rs 25 cr illegal foreign remittances

A case has been registered against an Agra-based chartered accountant for allegedly facilitating illegal transfer of nearly Rs 25 crore abroad to non-existent and shell companies using forged tax certificates.

The FIR was lodged on Sunday following a complaint by deputy director of income tax (investigation), unit-1, Agra, Manoj Kumar. The complaint followed a five-day search and seizure operation launched on Aug 18 by the principal director of income tax (investigation), Kanpur, at the Tajganj residence of the accused, Rehan Khan.

According to the complaint, Khan issued fraudulent Form 15CB tax determination certificates without conducting mandatory verification of underlying transactions, agreements or supporting documents. Multiple remitter firms used these certificates across 18 transactions to transfer funds out of the country under the guise of payments for freight, shipping, telecommunications, computer services and digital marketing.

DCP (city) Sayed Ali Abbas said, “An FIR has been filed under BNS sections 318 (cheating), 234 (issuing or signing false certificate), 61 (criminal conspiracy), 336 (forgery) and 340 (forged document or electronic record) on the complaint of the income tax department. We will proceed based on the evidence gathered.”

An income tax official privy to the case said, “The investigation uncovered substantial evidence that Rehan Khan helped transfer crores of unaccounted money abroad. During questioning, Khan admitted that another chartered accountant, Abhishek Gupta, and a private individual named Nikhil Harwani were also involved in the money-laundering network.”

Under the Income Tax Rules, 1962, and Reserve Bank of India (RBI) guidelines, authorised foreign exchange dealers require remitters to submit a certified Form 15CB issued by an independent CA. The rules mandate that the CA verify the legitimacy of the agreement between the remitter and foreign beneficiaries before clearing any outward overseas remittance.
